A local ordinance requires that, when operating a motorboat on a lake, the operator of the boat must always keep the boat a distance of at least 100 yards from public beaches.  While operating a motorboat on a lake, Martin steers the boat to approximately 75 yards of a public beach and crashes into a sailboat, causing severe injuries to Larry, the other boater, and damages to Larry's boat (assume the law permits sail boats to sail up to 70 yards from a public beach).  Is Martin negligent per se?
